General Terms and Conditions

As of: April 2026 – We reserve the right to amend these General Terms and Conditions 

Section 1 – Scope and Subject Matter

(1) These General Terms and Conditions (hereinafter “GTC”) govern the use of the web application IQONIC.ai (hereinafter “Web App”), operated by SkinTech Corp. GmbH, Zimmerstraße 50, 10117 Berlin, Germany (hereinafter “Provider”).

(2) The Web App provides AI-powered skin and hair analysis as well as product recommendations based thereon. The Web App is made available as an embedded tool on the websites of the Provider’s partner companies.

(3) Use of the Web App is free of charge for the end user (hereinafter “User”).

(4) Any deviating, conflicting or supplementary terms and conditions of the User shall not become part of the contract unless the Provider expressly agrees to their applicability in writing.

 

Section 2 – Conclusion of Contract

(1) A usage contract between the Provider and the User is concluded upon the User’s first use of the Web App.

(2) The User confirms upon each use that they have read and agree to these GTC.

(3) The contract language is German. An English translation is provided for convenience only; in the event of discrepancies, the German version shall prevail.

 

Section 3 – Requirements for Use

(1) Use of the Web App is exclusively permitted for persons who have reached the age of 18.

(2) The User warrants that all information provided, in particular data entered for the skin and hair analysis, is truthful and accurate.

(3) The User requires an internet-enabled web browser. The technical requirements for using the Web App are the User’s responsibility.

 

Section 4 – Description of Services

(1) The Web App analyses images uploaded by the User as well as information entered by the User using artificial intelligence and provides a skin and/or hair analysis on that basis.

(2) Based on the analysis results, product recommendations are displayed to the User. These recommendations are based on a recommendation algorithm curated by the Provider’s partner companies.

(3) The Provider endeavours to make the Web App available without interruption. There is no entitlement to permanent availability. The Provider reserves the right to temporarily or permanently discontinue the Web App.

 

Section 5 – No Medical Advice

(1) The analyses and recommendations provided by the Web App expressly do not constitute medical advice, diagnosis or treatment recommendations.

(2) The analysis results do not replace consultation with a physician, dermatologist or other healthcare provider. The User should always seek medical advice in the event of health concerns or questions.

(3) The Provider does not warrant the accuracy, completeness or suitability of the analysis results for the User’s individual case.

 

Section 6 – Product Recommendations

(1) The product recommendations displayed in the Web App are generated on the basis of an algorithm curated by the respective partner companies of the Provider.

(2) The Provider assumes no liability for the recommended products, their quality, efficacy or tolerability. The purchase and use of recommended products are exclusively subject to the terms and conditions of the respective seller.

(3) No purchase contract for the recommended products is concluded between the Provider and the User.

 

Section 7 – User Obligations

(1) The User undertakes to use the Web App only for its intended purpose.

(2) The User shall not upload any content that is unlawful, offensive, dangerous or otherwise objectionable, or that infringes the rights of third parties.

(3) The User shall not use the Web App in any manner that impairs the operation or security of the Web App, in particular shall not carry out any automated access (bots, scraping).

(4) The User may only upload their own images. Uploading images of third parties without their consent is prohibited.

 

Section 8 – Intellectual Property

(1) All content of the Web App (texts, graphics, software, algorithms, designs) is protected by copyright and is the property of the Provider or its licensors.

(2) The User is granted a simple, non-transferable, non-sublicensable right to use the Web App within the scope of these GTC.

(3) The analysis results may be used by the User for private purposes. Commercial use of the analysis results without the Provider’s prior written consent is prohibited.

 

Section 9 – Liability

(1) The Provider shall have unlimited liability for damages arising from injury to life, body or health, as well as for intent and gross negligence.

(2) In cases of slight negligence, the Provider shall only be liable for breach of material contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable, typically occurring damage.

(3) Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

(4) The Provider shall in particular not be liable for:

  • Damages arising from following product recommendations;

  • Damages arising from inaccurate or incomplete analysis results;

  • Decisions made by the User on the basis of analysis results;

  • Availability, quality or tolerability of recommended products.

 

Section 10 – Data Protection

Information on the processing of personal data can be found in our Privacy Policy at https://www.iqonic.ai/privacy. The Privacy Policy is a separate document and does not form part of these GTC.

 

Section 11 – Term and Termination

(1) The usage relationship is concluded for an indefinite period and may be terminated by either party at any time without notice.

(2) The Provider is entitled to discontinue the Web App at any time and without prior notice.

(3) The right to extraordinary termination for good cause remains unaffected. Good cause exists in particular if the User breaches Section 7 of these GTC.

 

Section 12 – Amendments to the GTC

(1) The Provider reserves the right to amend these GTC with effect for the future. The User will be notified of the amended GTC upon their next use of the Web App and asked to confirm them again.

(2) If the User does not agree to the amended GTC, further use of the Web App will not be possible.

 

Section 13 – Governing Law and Jurisdiction

(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the User is a consumer, the mandatory consumer protection provisions of the state in which the User has their habitual residence shall apply insofar as they are more favourable.

(3) The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

Section 14 – Severability Clause

Should any provision of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
